1. Legal framework
This Policy is written in accordance with:
- Directive 2011/83/EU of the European Parliament and of the Council, on consumer rights.
- Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users (hereinafter, "LGDCU").
- The rest of the European and Spanish regulations applicable to consumer protection.
This policy applies only when the buyer acts as consumer or user in accordance with Art. 3 LGDCU. For professional clients or companies, the refund conditions are those agreed in the specific commercial proposal.
2. Right of withdrawal: general rule
In accordance with Art. 102 LGDCU, the consumer has 14 calendar days from the conclusion of the contract to withdraw without the need for justification, in distance contracts.
3. Exception applicable to downloadable digital products
The Art. 103.m LGDCU establishes that the right of withdrawal IS NOT APPLICABLE to the supply of digital content not provided on a material medium when these two conditions are met:
- That the execution has begun with the prior and express consent of the consumer.
- That the consumer has expressly recognized that, once execution has begun, he or she loses the right of withdrawal.
In our case, "start execution" is equivalent to making the download file available or activating the license. Therefore, during the purchase process we request an express acceptance checkbox with the following text or an equivalent:
"I request that the digital supply begins immediately and I expressly recognize that, once the download has started or the license is activated, I lose the right of withdrawal provided for in Arts. 102 to 108 LGDCU."
If you DO NOT check that checkbox when purchasing, you retain the right of withdrawal for 14 calendar days and you may request it in accordance with section 6 of this policy.
4. Own voluntary refund policy
Even when we are not legally obliged to refund (because the right of withdrawal has expired), we apply a broader commercial policy. We accept refund requests in the following cases:
- Unresolved technical failure: the product has a reproducible defect that prevents its use in accordance with the published description and our support has not been able to resolve it within a reasonable period of time.
- Product manifestly different from that described: the real characteristics do not correspond to the product sheet in essential aspects (not in minor details).
- Double charge or erroneous charge: there has been a duplicate charge or for an amount different from the confirmed order.
- Price typographical error: the published price was manifestly wrong (e.g. a wrong decimal). In this case we can cancel the order and refund in full.
- Purchase made without downloading: If you request a refund within 14 calendar days and you have not downloaded the file or activated the license, we will refund you without the need for justification.
5. Cases in which the refund is NOT applicable
We do not accept refund requests when any of the following circumstances apply:
- You have downloaded the file or activated the license after having expressly accepted the loss of the right of withdrawal.
- The product works correctly, but it does not meet your subjective expectations (it does not meet a use case not described in the sheet).
- The problem arises from your installation environment: unsupported PHP version, conflict with other plugins, server configuration, etc.
- You have made modifications to the code that do not allow the bug to be reproduced in the original version.
- This is a professional service already provided (consulting, integration, support): the work performed is invoiced according to the agreed progress.
- This is a custom development already delivered totally or partially in accordance with the signed proposal, except for demonstrable defect.
- This is a subscription already consumed in whole or in part (the proportional part of the unconsumed subscription can be refunded).
- More than 14 calendar days have passed since the date of purchase (except for a defect claimed within the legal warranty period).
- The request constitutes an abuse of rights (repeated purchases and refunds of the same product, use of the downloaded file for resale, etc.).
6. How to request a refund
To request a refund:
- Send an email to [PENDIENTE DE COMPLETAR] with the subject "Refund request".
- Includes:
- Order or invoice number.
- Email associated with the purchase.
- Detailed reason for the request.
- If applicable: captures, logs or any evidence of the problem.
- We will respond to you within a maximum period of 5 business days.
Alternatively, if you are a consumer and want to exercise the right of withdrawal provided for in Art. 102 LGDCU (when still applicable), you can use the following official form model:
7. Term and method of processing
Once the application is approved:
- The refund is processed within a maximum period of 14 calendar days from approval, in accordance with Art. 107.1 LGDCU.
- The payment is made to the same payment method used in the original purchase, unless you agree with us on a different one.
- The actual availability of the money in your account depends on your bank or payment gateway (Stripe / PayPal), and may take between 5 and 10 additional business days.
- If the request is accepted before starting the execution, no cost is charged.
8. Legal guarantee of conformity (consumers)
Regardless of the refund policy, consumers enjoy the legal guarantee of conformity provided for in Arts. 114 et seq. of the LGDCU: 3 years from delivery for goods and digital content, in the event of non-conformities existing at the time of delivery. During this period you can demand, free of charge, the bringing of the product into compliance (repair or replacement), a price reduction or, where appropriate, the termination of the contract.
